On 16 June 2021, a webinar with the participation of Prof. Ruffolo will be held, dedicated to the topic “Class action and collective injunctions: the new rules”, and organized by the Milan Bar Association. The event will be an opportunity to discuss the possible new scenarios following the recent entry into force of Law no. 31/2019 (in force since 19 May 2021), which has reformed the rules on class action and collective injunction.

The reform profoundly affects both of said instruments, which are no longer confined to consumer sector and have become part of the Italian Code of Civil Procedure, thus turning into general actions. Many provisions are likely to have a strong impact on the business world. In particular:

  • with regard to class actions, for example, the possibility of adhesion even after the deposit of the judgment, and the provision of “bonuses” to encourage the proposal of class actions;
  • with regard to collective injunctions, they may now be proposed (no longer only by associations and representative bodies, but) by "anyone", with the right, also for the individual, to request the adoption of injunctive and corrective measures against companies.

The webinar will also host the presentation of the most recent volume edited by Prof. Ruffolo, Class action ed azione collettiva inibitoria - Commento sistematico alla legge 12 aprile 2019, n. 31, published by Giuffrè-Francis Lefebvre, which analyses in detail the innovations brought by the recent reform.
